1. Acceptance of Terms
By subscribing to or using any of the services provided by Netherlands Server Hosting (VPS, Dedicated, Cloud, Web Hosting, Domain Registration, etc.), you agree to be bound by these Terms & Conditions (“ToS”), the SLA, the Privacy Policy, and any other applicable policies (Acceptable Use Policy).
2. Definitions
Brief definitions (examples):
- “Services” — any hosting, cloud, domain registration, backup, or support services provided.
- “User Content” — any data, files, websites, applications, or content uploaded, stored, processed, or served via our servers.
- “Account” — your user account created to access and manage services.
3. User Responsibilities & Acceptable Use
- You are responsible for maintaining the security of your account credentials.
- You must not use our services to host, store or transmit illegal, malicious, infringing or harmful materials (e.g., malware, spam, copyrighted content without authorization, etc.). This is part of our Acceptable Use Policy (AUP) which you must follow.
- You are responsible for maintaining backups of your own data unless backup services are explicitly part of your plan.
- You must ensure your use of services does not overload server resources unduly (e.g. causing performance degradation for others).
4. Payment, Billing & Renewal
- All fees are due in advance as per the plan selected.
- Failure to pay may result in suspension or termination of services.
- Renewal terms, refund policy, and charge-back procedures — as per the plan/order form.
5. Termination & Suspension
- We reserve the right to suspend or terminate services immediately if you breach the ToS or AUP.
- Upon suspension/termination, we may delete or archive your data; we are not responsible for data loss if proper backups were not maintained by you.
- Client may also terminate the contract, following any defined notice period.
6. Limitation of Liability / Disclaimer
- Netherlands Server Hosting will not be liable for any indirect, consequential, or incidental damages — including loss of data, revenue, or business — arising from use (or inability to use) of services.
- Our total liability for direct damages will be limited to the amount paid by you in the last billing cycle (or any other defined cap).
- We make no warranties beyond those expressly defined in the SLA.
7. Modification of Terms
We may modify these Terms & Conditions at any time. We will notify you of material changes (email, website notice). Continued use of services after such changes constitutes your acceptance of the modified ToS.
8. Governing Law & Dispute Resolution
Specify the governing law (laws of India, if your business is India‑based), jurisdiction, and dispute resolution mechanism (arbitration / courts / mediation as per your preference).
